Why consent is required
Recording a conversation requires valid consent. Without the required consent, no recording may take place. The recording consent is therefore the basis for whether a recording may be created at all.
Nexcal provides the technical settings with which you define whether and under what conditions recording happens. The decision about lawfulness and the specific arrangement in your use case rests with you as the workspace operator.
How consent works together
- Recording must be permitted at the workspace and campaign level.
- The required consent must be in place for the respective conversation.
- If one of these conditions is missing, no recording is created.
The transcript and summary are to be distinguished from the recording. Even without a recording, a conversation can be documented, provided the corresponding settings allow it.
Wichtig: Before using recordings, carefully check the legal requirements for your use case. Nexcal does not make a legal assessment of your campaign and does not provide legal advice.
What applies without consent
If no valid consent is in place, Nexcal does not create a recording of the conversation. The conversation can still be documented as a transcript or summary, provided the corresponding settings allow it and it is permitted. If a contact objects to being recorded during the conversation, this request should be respected and the configuration checked accordingly.
Data protection and responsibility
The data protection classification of consent is described in the article recording consent in the privacy section. Also note do-not-call and opt-out if a contact objects to being contacted or recorded.
